Fox seeks dismissal of lawsuit filed against it by Smartmatic

Fox News filed a request to dismiss the lawsuit filed against it by Smartmatic.

The news broadcaster was sued by Smartmatic last week alleging that “Fox and its hosts published defamatory and disparaging statements while reporting on allegations about Smartmatic’s role in the election,” the lawsuit stated.

Fox argued that Smartmatic has not identified any statement that the network made that is actionable as defamation and that it failed to publish the challenged statements.

Fox also contends that it delivered its commitment to “inform fully and comment fairly” on the newsworthy topic of election challenges brought by former President Donald Trump, the Epoch Times reported.

“If the First Amendment means anything, it means that Fox cannot be held liable for fairly reporting and commenting on competing allegations in a hotly contested and actively litigated election. We are proud of our election coverage which stands in the highest tradition of American journalism,” Fox News Media said in an emailed statement to The Epoch Times.

The motion to dismiss Smartmatic USA Corp., Smartmatic International Holding B.V., and SGO Corporation Limited vs Fox Corporation, Fox News Network LLC, Lou Dobbs, Maria Bartiromo, Jeanine Pirro, Rudolph Giuliani, and Sidney Powell case was filed in the Supreme Court of The State of New York County of New York.
